1. Overview
XVPN respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). We respond to properly submitted notices of alleged copyright infringement in accordance with the DMCA.
2. How to File a DMCA Notice
If you believe that content accessed through our service infringes your copyright, please send a written notice to our designated DMCA agent containing:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material, with enough detail for us to locate it (e.g., IP address, timestamp, user identifier if available).
- Your contact information (name, address, telephone, email).
- A statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

4. Our Response Process
- Acknowledgment: we acknowledge receipt of the notice within 24 hours.
- Review: our team reviews the notice for completeness and validity.
- Action: if valid, we take appropriate action, which may include blocking the identified IP address or node, terminating the associated account, and preserving relevant logs for law enforcement (connection metadata only, per our no-activity-log policy).
- Notification: where possible, we notify the affected user of the takedown.
5. Counter-Notification
If you believe your content was removed in error, you may file a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material that was removed.
- A statement under penalty of perjury of good-faith belief that the material was removed by mistake or misidentification.
- Your name, address, telephone number, and consent to jurisdiction.
6. Repeat Infringers
In accordance with the DMCA and our Terms of Service, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.
7. Limitations
As a VPN service with a strict no-activity-log policy, our ability to identify specific users or content may be limited. We cooperate to the fullest extent possible within the constraints of our privacy architecture and applicable law.
